This is a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2254 brought by petitioner, who is incarcerated at the Joseph Harp Correctional Center, Lexington, Oklahoma pursuant to judgment and sentence of the District Court for Payne County, Oklahoma on September 21, 1976 in case numbers CRF-76-146 and CRF-76-148, in which petitioner was sentenced to concurrent ten year terms of imprisonment for the offenses of Rape in the First Degree and Sodomy.
