*367The defendant in error brought suit against the plaintiffs in error on a bond, executed by the Construction Company as principal and the Surety Company as surety, conditioned upon the faithful performance of a contract between the Construction Company and the defendant in error for the construction of a district irrigation system.
On trial to the court plaintiff had judgment for $100,000, the penalty named in the bond, and the case is now here on error.
