On October 11,1927, the petitioner, Stanley J. Gottsehalk Construction Company, filed its petition against the defendants, Victor C. Carlson- et al., for a mechanic’s lien upon certain property known as the Indian Wood Subdivision. The rights of the parties, as contended by petitioner, arose out of two contracts, one in writing and the other by parol. One, referred to as the sidewalk contract, was evidenced in writing, set forth in the petition, and the other resting in parol was called the paving contract.
