The appellee recovered a judgment for the sum of 8900 against the appellant, the City of Bloomington, on account of damages alleged to have been sustained by reason of the raising of the grade of the street in front of the property owned and occupied by the plaintiff as a residence. The damages complained of were, that dust and water were thrown upon the lot, and the property was rendered unsightly and unsalable because it was lower than the street as raised.
