Appeal from an order of the Supreme Court (Bradley, J.), entered November 3, 2006 in Ulster County, which granted plaintiffs motion for a preliminary injunction.

Flaintiff is the owner of a shopping mall in the Town of Ulster, Ulster County. The mall consists of a single large building with *624an enclosed common area, two anchor stores at each end and 30 retail stores between them. One of plaintiffs 32 tenants is the United States government, which maintains a recruitment center for all four branches of the armed forces.
