This was a suit on open account for $861.10 principal, besides interest, in which the jury returned a verdict for the plaintiff for $264.22. The defendant brought the case to this court by bill of exceptions, complaining of the overruling of his demurrer to the plaintiff’s petition, and of the refusal to grant his motion for a new trial. It appears from the petition that, prior to the bringing of the suit, there had been a partnership between the plaintiff and the defendant, “which was formed on or about February 22, 1899, and was dissolved seventeen months thereafter.” The sum sued for was…
