Appeal from District Court, Grady County; Will Linn, Judge. Hugh Pope was convicted of manslaughter in the first degree, and he appeals. The plaintiff in error, Hugh. Pope, hereinafter referred to as the defendant, was informed against for the’murder of Marvin Chitwood, and, upon trial, was convicted of manslaughter in the first degree. The evidence shows that the defendant and the deceased, Marvin Chitwood, were, before the night of the fatal difficulty, good friends.

(after stating the facts as above). This appeal is prosecuted from a judgment of conviction rendered in the district court of Grady county on the 5th day of February, 1916, in pursuance of the verdict finding the defendant guilty of manslaughter in the first degree, and fixing his punishment at imprisonment in the penitentiary for a term of four years.
