In the second count of the complaint the plaintiff alleges that on October 2d, 1905, the plaintiff and defendants entered into an agreement whereby the plaintiff was to furnish all material and labor for the erection of the buildings known as The Misses Ely School Building at Greenwich, Connecticut, in accordance with the plans and specifications of Carrere and Hastings, architects, with such modifications as might be desired by the defendants, in consideration of the payment to it by the defendants of a sum equal to the cost of the work and $7,500 commission, and 5 per cent. upon the cost of…
