Defendants appealed from a decree adjudging some, of the operations of their fueling dock on the St. Clair river in the city of Port Huron a nuisance.

For many years there has been maintained a fueling dock at the place in question, supplying vessels and other consumers with coal. Steamships have supplanted sailing vessels and this has created an increased demand for coal by vessels plying the Great Lakes. This demand has led to larger supplies of coal being unloaded at the dock from carrying vessels, the handling and storage thereof, the supplying of vessels therewith, and the installation of…
