In the court below, John I. Mc-Duffee, trustee, brought suit in December, 1896, against the lieston-ville, Mantua & Fairmount Passenger Railway Company, for infringement of patent No. 546,059. That patent had been applied for by William Sehlesinger on application No. 183,871, and was later issued to said McDuffee as trustee by virtue of certain writings hereinafter recited.
