The plaintiff sues as the husband of Mary Freeman, who is alleged to have been injured by the negligence of defendant while she was a passenger on one of its cable cars, on the eighteenth day of July, 1900. The injury complained of occurred at the crossing of defendant’s cable tracks at Twelfth street and Troost avenue in Kansas City, Missouri.
