The third count of the complaint was as follows: “Plaintiff claims of the defendant the sum of $30,000 as damages for injuries received ,hy him on, to wit, the 15th day of A[ugust, 1907. On or about said date, the defendant wa.s a corporation engaged, among' other things, in running freight trains composed of engines and freight cars from Nashville, Tenn., to Decatur, Ala.
