YOUNG, Justice.
This appeal followed the sustaining of general demurrer and all special exceptions to appellant’s trial pleading. Referring to the parties as in the trial court, the defendants were E. S. Randerson, Sheriff of Floyd County, and United States Fidelity & Guaranty Company, surety on his official bond. Previous to the instant litigation, and in the 101st District Court of Dallas County, plaintiff had obtained judgments of foreclosure on three tracts of land in Floyd County — A. 'N.
