I. BACKGROUND AND FACTS

Plaintiff Andrew Chang (“Chang” or “plaintiff’) seeks judgment as a matter of law pursuant to Fed.R.Civ.P. 50(b), or, in the alternative, a new trial pursuant to Fed. R.Civ.P. 59(a).
