Mitchell, J.—

This is an action brought by R. Gr. Still against Frank Swanson to recover damages for personal injuries sustained in a collision between automobiles on the highway between Seattle and Tacoma. The jury returned a verdict for the plaintiff, which, upon being reduced else a new trial would be granted to the defendant, was accepted by the plaintiff. The defendant has appealed.

The charge of negligence against Swanson upon which the case was tried was reckless driving, consisting of excessive speed and lack of control of his automobile.
