Action of trespass, tried to the jury, upon the general issue, with notice of the special matters of defence hereinafter stated. The plaintiff brought the suit as trustee of Ezra B. Beebe, an assigning debtor, to recover for the seizure and conversion, by the defendant, of a yoke of cattle, alleged in the plaintiff’s declaration to have been in his possession as such trustee at the time of the seizure.
