Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered March 31, 1978, convicting him of manslaughter in the first degree and criminal possession of a weapon in the second degree, upon a jury verdict, and imposing sentence. Judgment reversed, as a matter of discretion in the interest of justice, and new trial ordered. Defendant’s testimony concerning the homicide was that the victim was trying to take money from him and threatened to shoot him if he did not comply. The deceased had, on two prior occasions, successfully taken money from the defendant in this manner.…
