Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered December 5, 1978, convicting him of murder in the second degree, upon a jury verdict, and imposing sentence. Judgment reversed, as a matter of discretion in the interest of justice, and new trial ordered. The defendant was a uniformed court officer in Supreme Court, Kings County, who was also employed by the New York City Transit Authority as a bus driver.
