Defendant, John Gorezyk, Commissioner of the Vermont Department of Corrections, appeals from a summary judgment of the superior court permanently enjoining him from implementing a new policy that would make prisoners convicted of violent felonies ineligible for furlough until the expiration of their minimum sentences. Plaintiffs are two prisoners who are subject to the new policy and a class consisting of all prisoners, present and future, who are incarcerated for committing a violent felony.
