LEEDY, Judge.

Hubert Leroy Amsden, Jr., was charged in the Reynolds Circuit Court with the crime of rape. Upon a trial before a jury he was convicted of the offense and sentenced to imprisonment in the penitentiary for a term of two years in accordance with the verdict. The trial court undertook to commute such sentence to a like term in the intermediate reformatory for young men (Algoa Farms), and he appealed.
