Appeal by the defendant from a judgment of the Supreme Court, Suffolk County (Mclnerney, *882J.), rendered August 17, 1990, convicting him of promoting gambling in the first degree (four counts), promoting gambling in the second degree, and possession of gambling records in the first degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed, and the matter is remitted to the Supreme Court, Suffolk County, for further proceedings pursuant to CPL 450.60 (5).
