OPINION
MURRAY, Justice.
This is a petition for certiorari to review a District Court judgment dismissing the appeal of the plaintiffs, Great American Nursing Centers, Inc., and Consolidated Subsidiaries 1 (taxpayers), as having been untimely filed.
The facts are undisputed. The taxpayers filed a consolidated tax return for the year 1976. The defendant tax administrator, disagreeing with the method used in computing the return, determined the amount due and owing the State of Rhode Island through the use of a method employed by the agency for a number of years.
