Appeal from a judgment of the County Court of Columbia County (Leaman, *771J.), rendered May 10, 1984, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the third degree.

Defendant was indicted for two counts of the crime of criminal sale of a controlled substance in the third degree. At the ensuing trial, Russell S.
