This case involves a tragic one vehicle accident in which a fifteen-year-old driver of a pickup was injured and his father, a passenger, was killed'. The plaintiffs instituted this action against the vehicle’s manufacturer and a local dealer claiming that a leak in the exhaust system caused carbon monoxide (“CO”) to infiltrate the truck’s cab, incapacitating both occupants. Finding the jury’s verdict in favor of the defense tainted by an evidentiary ruling, we have reviewed the evidence de novo and affirm the trial court’s ruling upon our determination that CO poisoning was…
