BURNETT, Judge.

Joseph R. Gauna stands convicted of possessing a controlled substance with the intent to deliver. The district court also found him to be a persistent violator. In this appeal, he argues that (1) a search warrant was issued without probable cause; (2) the state failed to disclose all information material to the defense; (3) the trial judge erroneously admitted evidence of other crimes; (4) the judge abused his discretion by allowing tardy filing of the persistent violator charge; and (5) the sentence imposed was excessive.
