TITUS, District Judge.

BACKGROUND

On May 8,1984, the District of Columbia (“D.C.”) awarded a contract to Kora & Williams (the “Debtor” or “K & W”) to build the Union Station Bus/Parking Garage and Rail Access Facilities (the “Union Station Contract”). The price of the contract was fixed at $24,850,000.00. Insurance Company of North America (“INA”) was K & W’s surety on this and other unrelated contracts.
