Action to confirm title, in plaintiff, to an undivided one-lialf interest in a 400-acre farm which be claims to own, under and by virtue of a certain deed of conveyance, signed on July 26, 1921, by bis brother, Llwellym M. Weston, since deceased. Tbe cause ivas tried to tbe court, findings made and judgment ordered in favor of plaintiff. Tbe defendant, Edwin M. Weston, made a motion, as an individual and as representative of tbe deceased’s estate, for amended findings or for a new trial, and appealed from an order of tbe district court denying bis motion.
