' This is an appeal from a judgment in favor ■of the plaintiff in an aetio-n for malicious prosecution. The complaint contained two counts — one for a prosecution for ■obtaining money under false pretenses, and the other for a ■subsequent prosecution for embezzlement. The action was once tried, and a judgment for the plaintiff was reversed by this court. 106 Wis. 633, 82 N. W. 556.
