FRY, Judge.

{1} This case involves an alleged prelitigation oral settlement agreement between Plaintiffs attorney and the attorney for Penske Truck Leasing (Penske) and Defendant Jones-Wilson. While both attorneys believed that they had agreed to a settlement during their phone call, they differed on whether Plaintiff s attorney had agreed to settle the claims against both Penske and Jones-Wilson or whether he had agreed only to settle the claims against Penske.
