MEMORANDUM

BAYLSON, District Judge.

I. Introduction

Presently before this Court is a Partial Motion to Dismiss, pursuant to F.R. Civ. P. 12(b)(6), filed by Defendants Upper Gwynedd Township (“Defendant Township”) and Officer Scott Clark (“Defendant Clark”) (collectively, “Defendants”). For the reasons set forth below, the Motion to Dismiss will be granted in part and denied in part.
