C. D. Peak and others brought a suit for the writ of mandamus against T. H. Wilkinson, the superintendent of the public schools of the City of Cuthbert, and against the members of the Board of Education of the city, to compel the defendants to permit the children of the plaintiffs to enter the public school of the City of Cuthbert without the payment of a matriculation fee alleged to have been demanded by the defendants. The defendants filed an answer admitting some of the allegations of the petition, and denying others. The case was heard upon an agreed statement of facts. The judge denied…
