LOCKWOOD, Justice.

The defendant, Dick Dean Holliday, was found guilty by a jury of the crime of attempted first degree burglary. From that judgment of conviction, he has perfected an appeal to this court.

The information filed in Pima County on September 8, 1961, charged that the defendant on August 25, 1961, attempted in the nighttime to commit burglary of the building located at 1120 South Wilmot Avenue, Tucson, Pima County, Arizona, to which defendant entered a plea of not guilty.
