The defendant was convicted under a count charging him with operating a motor vehicle upon a public way so that the “lives and safety of the public” might be endangered. This count is in proper form to charge a violation of the statute (G. L. c. 90, § 24) which makes it a criminal offence to operate a motor vehicle upon any way so that the “lives or safety” of the public might be endangered. See Commonwealth v.
