The defendant is charged with maintaining a public nuisance in violation of subdivision 1 of section 1530 of the Penal Law, defining the offense as “ unlawfully doing an act, or omitting to perform a duty which act or omission: 1. annoys, injures or endangers the comfort, repose, health or safety of any considerable number of persons ”.
