MEMORANDUM AND ORDER
ANN ALDRICH, District Judge.
This action concerns Bloedow’s seniority date as a locomotive engineer in the employ of CSX Transportation, Inc. (“CSX”). Under federal statute, Bloedow asserts three “hybrid” claims for breach of contract and breach of the duty of fair representation against CSX and his union, the Brotherhood of Locomotive Engineers (“BLE”). He also asserts a state common law claim for breach of contract. CSX and BLE filed summary judgment motions, which this court referred to a magistrate judge.
