FACTS

This matter comes before the court on the trustee’s motion for summary judgment. The question is whether the trustee’s denial of the brokerage customers’ claims for dividends that would have been earned had the funds been invested as in structed by the customers is proper under the Securities Investor Protection Act (“SIPA").
