This is an appeal from a judgment in favor of defendants in an action for an accounting under the terms of a written contract.
On November 22, 1930, plaintiffs Prank Jacklich and An thony Jacklich, as parties of the first part, entered into a contract with defendant Max Baer as party of the second part, wherein first parties agreed to pay Baer $5,000 upon the execution of the contract, an additional $5,000 within thirty days, and $5,000 three years from date.
