In 2013, the Defendant City of Chattanooga (the “City”) organized a task force of interested stakeholders to develop a plan to address anticipated, shortfalls in the Chattanooga Fire and Police Pension Fund (the “Fund”). In March 2014, the City Council passed an ordinance that adopted portions of the package proposed by the task force and incorporated those changes into the Chattanooga City Code (the “City Code”). At all times relevant to this litigation the City Code provided pensioners with a cost of living adjustment (“COLA”).…
