The court today limits the authority of the district courts of this circuit to enforce settlement agreements terminating litigation pending before them. Henceforth, a district court will retain jurisdiction to enforce such agreements only if the court succeeds in evidencing an intention to retain jurisdiction. Concluding that the district court did, “if barely,” retain jurisdiction over this case, the court proceeds to reach the merits and reverses the district court’s explicit finding that the defendants, and not the plaintiff, violated the settlement agreement.
