FOLLEY, Justice.

Josephine Scott, plaintiff below, filed this suit individually and as independent executrix of. the estate of A. J. Scott, her deceased husband, against W. P. Scott, defendant in the trial court. The petition upon which the cause proceeded to trial was filed December 14, 1936. This petition contained two counts. The first count was in the nature of trespass to try title, involving the southwest quarter of Section 23, in Block Y, of Bailey County, Texas.
