MESKILL, Circuit Judge:
The Equal Employment Opportunity Commission (EEOC) brought this action on behalf of Hugh Pierce claiming that Pierce’s former employers, Ethan Allen, Inc., and Ethan Allen Furniture Orleans Division (Ethan Allen), discharged Pierce because of his age in violation of the Age Discrimination in Employment Act of 1967 (ADEA), 29 U.S.C. §§ 621 et seq. At the end of the defendants’ case the district court, Parker, C.J., granted Ethan Allen’s motion for judgment as a matter of law. See Fed.R.Civ.P. 50(a).
