Plaintiffs, J. J. Zayti Trucking, Inc., and Detroit Councilman Jack Kelly, appeal from an order granting to defendant, City of Detroit, summary judgment pursuant to GCR 1963, 117.2(3).
Plaintiff Zayti, an unsuccessful bidder on a contract for rubbish hauling, sued defendant city to void the contract which had been awarded to the low bidder, Wiegand Trucking Company.
