In Error to the Circuit Court of the United States for the Southern District of New York. Action at law by Jacob Polonsky against the Pennsylvania Railroad Company and the Pullman Company. Judgment for defendants, and plaintiff brings error.

The facts as they appear from the testimony offered by the plaintiff are in brief as follows :

The plaintiff has resided in the city of New York for 19 years and is engaged in the wholesale manufacture of cloaks and suits. On the night of the 14th day of July, 1906, he left Pittsburg at about 10 o’clock, destined for New York, on a train of the Pennsylvania Railroad Company.
