My opinion is that Act No. 36 of the 2d Extra Session of 1934 is unconstitutional, for the following reasons:
First. The changing of the membership or composition of the sewerage and water board, by doing away with the seven resident taxpayers of New Orleans as members of the board and by placing on the board eight appointees of the Governor, violates one of the conditions on which the tax was levied and the bonds were issued, under the provisions of Act No. 6 of the Extra Session of 1899, which, by the constitutional amendment adopted pursuant to Act No. 4 of that session, became a part of…
