FINCH, Judge

This matter comes before the Court on cross-motions for summary judgment.

I. Background

For the purposes of this summary judgment determination, the parties have presented the following factual circumstances.

A. The FCCU Construction Project

In 1991, Hess Oil Virgin Islands Corp. and its parent Amerada Hess Corp. (collectively "HOVIC" or "Plaintiffs") undertook to construct an addition to HOVIC's existing refinery on St. Croix.
