On April 9, 1963, defendant was convicted by a jury of murder in the third degree under Minn. St. 609.195 (L. 1963, c. 753, § 609.195). 1 This appeal is from an order denying his motion for judgment of acquittal notwithstanding the verdict or, in the alternative, for a new trial.
