There are but two important questions arising upon this appeal, viz.: (1) Were the tax deeds introduced in evidence by the defendants on the trial in the circuit court duly recorded in the office of register of deeds of Marathon county on the 6th day of January, 1868, as found by the learned circuit judge? and (2) If' not so recorded, was the appellant’s right of action barred by the provisions of sec. 6, ch. 334, Laws of 1878?
