OPINION ALLOWING CHAPTER 7 TRUSTEE’S RIGHT TO OBJECT TO DEBTOR’S EXEMPTIONS POST-CONVERSION

This matter came before the Court at a hearing on September 21, 2004 on the Chapter 7 Trustee’s objection to the debtors’ claimed exemptions. The issue before the Court is whether upon conversion of a case under Chapter 13 to a case under Chapter 7, a Chapter 7 trustee may file objections to exemptions originally claimed by a debtor in a Chapter 13 ease.
