DAVIDSON, Judge.

Appellant was convicted of assault to rape, his punishment being assessed at four years confinement m the penitentiary.

The State’s testimony is to the effect that the alleged assaulted girl, Emily Smith, was over fourteen years of age. Appellant and his wife were at his father’s residence, and had been for a short time, appellant working about the country at various jobs. The father and mother of the prosecutrix were in Wilbarger County, and had been for three or four weeks. The father of prosecutrix was a renter of the elder Odell, occupying a small house on the property and…
