New York Court of Appeals

Decided December 10, 1878PublishedCited by 43 opinions

Appeal from judgment of the General Term of the Court of Common Pleas, affirming a judgment in favor of defendant, entered upon an order dismissing complaint on trial. This action was upon a lease under seal of certain premises in New York, which lease was executed by “ J. Eomaine Brown, agent,” as lessor and by defendant as lessee. The facts appear sufficiently in the opinion. Plaintiffs, being the principals of Brown, can sue upon the agreement made in his, Brown’s name.
